The SOS Feature — What It Is and What It Is Not

The SOS feature exists to alert your family members that a situation needs their personal attention. It is not a medical alert system. It is not connected to 911, to any hospital, or to any emergency dispatcher. It must never be used as a substitute for calling 911 when a life is at risk.

Addison’s Diary is not an emergency service. It is not monitored. Notifications are not guaranteed. In any situation where a life may be at risk — stop, call 911, and get real help on the way.

PREAMBLE — GOVERNING DOCUMENTS, THIRD-PARTY SERVICES, AND SECURITY

Governing Documents

This Platform Disclaimer is one of several legal instruments that govern your use of the Addison’s Diary platform. By accessing or using the Platform, you agree to be bound by each of the following documents, all incorporated herein by reference:

Together, these seven documents constitute the complete legal framework governing your relationship with Pribco LLC and your use of the Platform. In the event of any conflict between this Disclaimer and the Terms of Use, the Terms of Use shall control except with respect to the specific medical, regulatory, and liability disclaimers set forth herein.

Third-Party Service Providers — Disclaimer of Liability

The Platform operates through Amazon Web Services (cloud infrastructure), Stripe Inc. (payment processing), Postmark/Wildbit LLC (transactional email), Twilio Inc. (SMS delivery), and mobile app store distribution partners. On the public landing page, Pribco LLC also uses Meta (Facebook Pixel and Conversions API for advertising) and Google Analytics 4 (GA4), both of which are active on the public landing page. Google reCAPTCHA (bot protection) and Rewardful (affiliate referral tracking) are not currently active but may be used in the future. These tools operate only on the public landing page before sign-up and never inside the authenticated app or on any page where health or care data is present. Each provider is contractually bound to protect your information solely to deliver the service. Pribco LLC expressly disclaims all liability for any loss, harm, damage, interruption, or failure caused by the acts, omissions, errors, negligence, system failures, outages, security incidents, or service interruptions of any third-party provider.

If you are a paying subscriber, you may request a complete list of our current third-party service providers, together with links to each provider’s terms of service and privacy policy, by contacting us at privacyandlegal@pribco.com. We will respond to such requests within 30 days.

Security — Policy Reference and Disclaimer

Pribco LLC employs reasonable safeguards including encryption in transit and at rest, two-factor authentication, strict per-family data isolation, IAM-enforced MFA break-glass role controls for operator access, and WORM Object Lock immutability for legal and consent records. Full detail is in our Privacy Policy (Section 5) and HIPAA Notice and Health Data Policy (Sections 4 and 5). No security measure is perfect or impenetrable. Pribco LLC expressly disclaims all liability for any security incident, breach, unauthorized access, or loss of data arising from vulnerabilities in third-party systems, circumstances beyond our reasonable control, your failure to maintain account credentials, or the inherent limitations of internet-based communications.

Your Information Is Yours — You Control Who Sees It

Pribco LLC does not access, review, use, share, sell, or process the personal or sensitive information you enter into the Platform except to the limited extent strictly necessary to operate and deliver the service, or as required by applicable law, valid legal process, or mandatory reporting obligations. Disclosures to service providers are made under strict contractual restrictions for service delivery only and are not commercial sharing.

1. Not a Medical Device

Addison’s Diary is not a medical device under any applicable law, regulation, or standard, including the United States Federal Food, Drug, and Cosmetic Act (FD&C Act) as interpreted by the FDA. The Platform does not diagnose, detect, monitor, predict, treat, cure, prevent, or mitigate any disease, disorder, injury, or medical condition. It does not acquire, process, or analyze physiological data or clinical signals for any medical purpose. It does not provide any output intended for medical decision-making.

All marketing, sales, support, and partner communications about Addison’s Diary must not describe or imply medical-device functionality. Use of the Platform in a manner contrary to this section is prohibited under the Terms of Use and may result in account suspension.

2. No Medical Advice or Analysis

Nothing in Addison’s Diary — no feature, no notification, no content, no message, no journal entry, no medication record, no care log — constitutes medical advice, clinical guidance, diagnosis, prognosis, or treatment recommendation or analysis of any one or more of same. No use of this Platform creates a provider-patient relationship or any duty of care between Pribco LLC and any user or patient.

For any question about a medical condition, symptom, medication, treatment, or care decision — no matter how minor it may seem — contact your licensed physician, nurse practitioner, or pharmacist directly. Do not rely on information in this Platform for that answer. See also the Terms of Use for the binding obligations and limitations related to medical content and decision-making.

Before enabling medication tracking, SOS alerts, or caregiver check-in features, you acknowledge that these features are organizational tools only and are not substitutes for professional medical care or emergency services.
This acknowledgment was made in accepting the disclosures when you created your account and is recorded as part of your account record and agreement for the platform’s use.

3. Not a Substitute for Professional Medical Care

Addison’s Diary does not provide, replace, supplement, or in any way replicate the services of licensed physicians, nurses, pharmacists, therapists, counselors, social workers, or any other licensed healthcare or mental health professional.

The Platform does not provide telemedicine, telehealth, or remote patient monitoring services. It is not a tool, device, or interface used to interact with a family member’s medical providers directly — that responsibility remains entirely with the family. It is not a channel for communicating with, transmitting information to, or receiving information from any medical provider, healthcare system, hospital, clinic, pharmacy, hospice organization, or other clinical or medical provider entity. All communication between your family and your loved one’s medical providers remains entirely the responsibility of the family, conducted through whatever direct channels the family and their providers establish independently of this Platform.

4. Medications — No Clinical Verification

The medication tracking feature is an organizational reference tool for family coordination ONLY.
It does NOT verify that medications are correct, safe, or appropriate for any patient.
It does NOT check for drug interactions, contraindications, or dosing errors.
It does NOT perform any clinical verification, analysis, or review of any kind.
Medication data shown is user-entered only — no clinical databases are used.
Log entries are made by family members — not verified by any clinician.
Always follow the instructions of the prescribing physician and pharmacist.
Never adjust, add, or discontinue a medication based on information in this Platform.
For any medication question: contact your physician or pharmacist directly.

Addison’s Diary does not perform, provide, or facilitate clinical verification, pharmacological review, drug interaction screening, contraindication checking, dosage validation, or any other form of clinical evaluation with respect to any medication, treatment, therapy, procedure, care plan, or medically directed instruction. All decisions regarding medication administration and care plans must be made exclusively by, or under the direct supervision and guidance of, the patient’s licensed healthcare providers.

5. Notifications and Alerts — Delivery Not Guaranteed

Addison’s Diary sends notification emails and, for opted-in users, SMS text messages for SOS alerts, “I’m OK” wellness check-in notifications, and two-factor authentication (MFA) codes. These notifications are provided on a best-effort basis only and are not guaranteed to be delivered accurately, completely, or in a timely manner. Notifications may be delayed, arrive out of order, or fail to deliver entirely due to email delivery systems, SMS carrier processing, network interruptions, device settings, spam filtering, or other technical factors beyond Pribco LLC’s control.

Pribco LLC expressly disclaims all liability for any failure, delay, or non-delivery of any notification. Notifications are sent according to your preferences. See our Privacy Policy and Terms of Use (Section 8) for consent, frequency, opt-out, and data use information. Message and data rates may apply for SMS. Delivery is not guaranteed.

Never rely on this platform’s notification system as your sole safeguard for time-sensitive medical care. If a medication must be given at a specific time and missing it could harm the patient, use dedicated medical alarms, professional caregiver protocols, or clinical medication management services in addition to or instead of this Platform.

6. The “I’m OK” Check-In Feature

The “I’m OK” feature allows a patient or independent senior to send a daily wellness signal to chosen family members. It is a personal family communication feature only. It is not a medical alert system, personal emergency response system (PERS), or falls detection system. It is not monitored by Pribco LLC, any clinician, or any emergency service.

A missed check-in is a family notification only — it does not dispatch anyone to help. Configure alternate contacts and redundant safeguards when setting up this feature. If you are concerned for someone’s safety, contact them directly and, if you believe they are at risk, call 911.

7. Not a HIPAA-Covered Platform

Pribco LLC is not a HIPAA covered entity or business associate. The Platform is not HIPAA-certified and has not been independently audited for HIPAA compliance. The accurate description of our posture is HIPAA-adjacent — we implement security controls appropriate for sensitive personal information and have chosen to build the Platform with HIPAA-minded practices, but we do not process Protected Health Information (PHI) for covered-entity or business-associate purposes.

Do not use this Platform as a system of record for information subject to HIPAA obligations. Accounts identified as using the Platform as a system of record for PHI may be suspended. Addison’s Diary is not a mental health platform, crisis service, or counseling service. It does not provide therapy, counseling, psychological support, or crisis intervention. If you or someone in your family is experiencing a mental health crisis:

All content in Addison’s Diary is entered by users. Pribco LLC does not review, verify, validate, or endorse any user-entered content. We make no representation or warranty that any information in the Platform is accurate, complete, current, or suitable for any purpose. You are responsible for keeping information current and accurate. Always verify critical care information directly with licensed healthcare providers. For correction or deletion of inaccurate information, see our Privacy Policy (Section 12) and Data Deletion and User Rights Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIBCO LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: ANY MEDICAL OUTCOME, HARM, INJURY, ILLNESS, OR DEATH ARISING FROM USE OF OR RELIANCE ON THE PLATFORM; ANY ERROR, INACCURACY, OR OMISSION IN USER-ENTERED CONTENT; ANY FAILURE, DELAY, OR NON-DELIVERY OF ANY NOTIFICATION OR ALERT; ANY UNAUTHORIZED ACCESS TO OR SECURITY BREACH OF YOUR ACCOUNT; ANY ACT, OMISSION, OR NEGLIGENCE OF ANY THIRD-PARTY SERVICE PROVIDER; OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND AND YOU EXPRESSLY WAIVE AND DISCLAIM SAME TO THE FULLEST EXTENT PERMITTED UNDER THE LAW.

These limitations do not apply where prohibited by mandatory consumer protection laws in your state, or to claims arising from intentional misconduct. See the Terms of Use for the complete limitation of liability, including any damages caps and exclusions.

Where a disclaimer or exclusion of liability is not legally permitted under the laws of the jurisdiction in which you reside, the total liability of Pribco LLC for any and all claims arising from your use of the Platform shall not exceed the greater of (a) the total subscription fees you have actually paid to Pribco LLC in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred dollars ($100.00). In all cases and to the fullest extent permitted by applicable law, all incidental, indirect, consequential, special, and exemplary damages are expressly disclaimed and waived, regardless of whether Pribco LLC has been advised of the possibility of such damages and regardless of the form of action.

This Disclaimer is governed by the laws of the State of Georgia, United States, without regard to conflict of laws principles, subject to any mandatory consumer protection rights applicable in your state that cannot be contractually waived. Disputes are subject to the arbitration and dispute resolution provisions of the Terms of Use.
